Hi i just found a site using my artwork from this site being used commercially to sell model jets .So ive just sent the company in germany a message asking if i can have a free jet !..What do you think my chances are ?

i'd have to be leary of a remote control aircraft company that tries to sell their planes with screen shots from a video game. very odd.

If they are using your image without permission, then you are fully entitled to ask for a free jet. You can always threaten with Legal Action otherwise since it is now allowed to use an image without permission that way.

 

A Jet is btw pretty much the value of the cost of the image, as well as damages of them using it without your permission.

It is bad form but I don't think that a screenshot qualifies as artwork and, more importantly, once you post an image on the internet (without disclaimers or copyright information) then it's fair game.

Unfortunately we do not give away free Hawks.

 

And since you do not give away free artwork, a copyright notification would help.

 

 

Anyway, the image of the Swiss Hawk is not on our website and as of now, our distributor is aware, this particular piece of art belongs to you.

Shame they removed the picture as the picy has my 3d model in it and I was gonn ask why they using pictures of it and not asked permission lol...

watermark the picture, and say where it is from, making it hard for them to take credit .

A screenshot is not different from other forms of digital art. Furthermore, just because something is posted on the Internet does not mean it is fair game for commercial interests to use them as they see fit. Yes, posting copyright information does help, but that a picture lacks it is not a valid excuse.

 

In Theory, private, non-commercial use is protected by fair use, but even then, few would be so mad as to try (or want) and pursue people who reposted things on their blogs. I do however know one - and it cost her a ton in court.

 

I am a photographer by profession, so I do happen to know a little about this sort of thing, especially as it happens to me from time to time.
