3Dmax and Win 8

How do you handle max 2009 on win 8??? I have already wasted precious time trying to find out how to fix this but I cant... 

 

When the pop up menus disappear from the screen, their boxes remain there, so I cant see a thing anymore... most annoying thing ever... I tried updating video driver.. no help. is there a fix to this? and if there is, how to apply?

 

64bit exe works normally but the exporter is only for 32bit ver...
